Eminent Domain

  • Handled numerous suits on behalf of property owners against governmental entities involving total or partial condemnation of property, including commercial and business property, business goodwill and various easements.
  • Won $3.5 million eminent domain jury verdict in suit where government entity claimed that property was worthless.  This case, which was affirmed by the First District Court of Appeal, involved an earthquake-damaged and environmentally-impaired property in downtown Oakland.  The City of Oakland had offered the owners only $1 for the property, claiming that the cost of demolishing the structure far exceeded the value of the property.  In addition to the $3.5 million jury verdict, the City of Oakland also was required to pay all the property owner's legal fees and costs.
